이 논문은 현재 우리 사회에서 시행되고 있는 여가 관련 법률의 현황과 주요 내용을 검토하고, 여가진흥법의 제정 필요성과 주요 내용을 제안하고 있다. 관광 분야를 제외하더라도 현재 시행중인 여가 관련 법률은 20개가 넘을 정도로 매우 다양하다. 문화예술, 출판인쇄, 체육스포츠, 게임 오락 등 여가 분야가 포괄적이고 광범위하기 때문이다. 이들 개별 여가 관련 법률들은 여가를 사회구성원이 누려야하는 보편적인 사회적 권리로 간주하고 사회구성원의 여가 복지, 여가 참여를 증진하기 위한 목적보다는 개별 산업의 진흥을 중요하게 생각하고 있다. 또한 다양한 개별 여가 관련 법률을 일관성있게 통할할 수 있는 법적 체계가 미흡하다는 문제도 있다. 여가 관련 개별 법률의 근거와 상위규범으로 작용할 수 있는 법률이 부재하다는 것이다. 여가진흥법을 제정해야 하는 것은 사회구성원의 여가권을 보장하기 위해 필요한 여가 진흥 및 삶의 질 향상에 대한 국가 및 지방자치단체 등의 책임과 의무를 규정하기 위해 필요하다. 또한 여가진흥을 위한 정부 정책의 효율적인 집행을 위해서도 필요하다. 그리고 주5일 근무제 등 새로운 여가환경 변화에 대비하기 위해 여가진흥법은 제정될 필요가 있다. 이러한 이유로 이 논문에서는 여가진흥법이 제정되어야 한다고 강조하고, 그 주요 내용을 제안하고 있다.
This study reviews the present condition of current leisure-related laws and describes the major contents of their laws, and proposes the necessity of legislation of Leisure Promotion Act. In Korea, over 20 leisure-related laws are enforcing (or operating) except for the tourism-related laws. This means that leisure include culture, arts, publication, sports, game and all other entertainment activities. Leisure-related laws consider leisure as a part of industry and stress the promotion of independent leisure industry. This study considers leisure as a kind of social rights that all citizens can and should enjoy to improve the quality of life. The necessities of legislation of Leisure Promotion Act are 1) to enact government's obligation to guarantee citizen's leisure rights, leisure promotion, and quality of life, 2) to provide for the change of leisure environments such as five work-day system in Korea.
